PROTECTION IN CASES OF FORCED LABOR. ECHR LAWYER

Any violation of human rights must entail their restoration and adequate compensation, and the labor rights of every person are no exception. It is especially important to defend one's fundamental rights in cases where violations are committed by the state.
If the state has allowed a situation of forced labor and has not taken prompt action to remedy it, recourse to the European Court of Human Rights is the best way to protect rights in such cases.
Article 4 of the European Convention.
Prohibition of slavery and forced labor
No one shall be held in slavery or servitude.
No one may be forced to perform forced or compulsory labor.


For the purposes of this article, the meaning of the term "forced or compulsory labor" does not apply to:
(a) to any work normally required during detention in accordance with the provisions of Article 5 of this Convention or on parole;
b) any service of a military nature or, in the case of a person renouncing it on the grounds of personal conviction in the countries where such refusal is recognized, the service required in lieu of compulsory military service;
c) any service required in the event of an emergency or natural disaster which endangers the life or well-being of society;
d) to any work or service which forms part of normal civic duties.
Instead, "forced or compulsory labor" means "any job or service that requires it." from any person under threat of punishment and for whom that person has not voluntarily offered his services. "
The right to free labor and the prohibition of coercion are unconditional and do not provide for any exceptions or derogations, even in cases of public danger that threatens the life of the nation.
